I will be leaving in the morning for the WVBBA Conference - Dinner tomorrow night and meeting Monday.
Tuesday morning I will leave from there to go to South Carolina. I finally have everything I need to get Executor on my brother's estate. Part of the problem is we were given bad info from the lawyer service but I got good advice from of all places, a season ticket rep for the Charlotte Hornets - call Probate and ask them what you need. Waivers on original forms signed & notarized from ex-wife and both kids, Will, certified death certificates, and proof I paid to get him out of hock. Tuesday at 3:30 I have to be at the Courthouse.
Meanwhile, my brother's Hornets rep (not the one who told me Probate) blew smoke up my butt causing me to lose the opportunity to sell several of his tickets - both before he finally told me how to put them up for sale and after. I did manage to sell his tickets for 3 games which put another $400 into his estate - I went cheap to sell instead of holding out and not selling.
Wish me luck, my friends. I have 3 days allocated to go to his mortgage bank, his checking account bank, his stock trader, and a realtor plus clean all the rest of his stuff out of the house. I am staying at a B & B - opted for that instead of a motel. Have to support each other. John's girlfriend is coming down one night to help me with clearing out the house the next day. She is a sweetie - that is my big regret about him dying, that they did not have a chance to grow old together. In my family, we celebrate having them in our lives rather than grieving for the loss.
I will be back Friday. Himself is not happy about being left alone, but he will manage.
I am back. While I was gone, Himself developed another heel problem. Back in the wheelchair - all by himself this time and did fine. Friends dropped in several times which I totally appreciated. Managed to get a speeding ticket attempting to get to the Probate appt - had nasty rain all down WV, then a traffic lane merge that was a standstill.Called my City Hall and had someone Goo the phone number and call for me - to reschedule would have had to wait 2 weeks (daughter coming in this week) and I was already in North Carolina. Their troopers are very polite. I am legal. House is on the market. Monday will tell all. Oh, although ex-s-i-l is bene in Will, to SC she is dead and gets nothing. IF there is anything left after paying bills, the kids will get it.
U{DATE: Signed with a realtor Thursday. The listing went up yesterday. JUST signed the offer agreement. Cash sale - closing March 24. And no Home Warranty asked for (decided to wait for asking before getting it so I saved that money).

Got a new hitch in today's mail. (Meeting ended at 4 today so decided to come hoe for tonight - off again in the AM)
A letter from his checking account bank. The feds pulled back his ss deposit - actually surprised it took this long. Thankfully, 3 car payments were made before this happened and I had sent a 'for services rendered' check that had been in a Christmas card as a deposit about 10 days ago AND 3 games of his season tickets to Hornets games that I put online sold (money deposited in his checking account) so the yank was covered. Wednesday I will go see what is left when armed with legal status. I have been blessed.
 
Were you told to open an estate account to receive all monies from the sale of the house and property? Not sure what rules apply in different states.
I submitted all the probate paperwork last week. Took a little running around but realized we paid an awful lot of money for the lawyer's assistant to drive the paperwork to the court for the last probate hearing!
You may be able to get the SSA money back depending on when he died vs when he received the money. I'm in the process of doing that now. The bank sent the money back in our case. They had no business doing that.

I told him I could not use that bank for the estate account because I do not have any branch in my State. I then went back to the mortgage bank that DOES have a branch here, opened the estate account and deposited the checking account money.
The man that bought some of my brother's furniture gave me a check for it - made out to me - so I was able to cash it to use to pay the utilities owed from the shut-off and pay deposit to turn on again so the house can be shown. Since I had just opened the estate account, I had no checks and it was not yet in "the system" so I could not use that money.
Now comes the hard stuff - finding how much he owes in California for his 15 minute marriage there (there is a judgement and I think it must be from that as it was something he was bitter about), getting his stock sold, getting PayPal to tell me how much is in that account (I do not have account numbers, but the girlfriend told me that is where he hid his money from California), and worst of all, tell Alice she inherits nothing. I am just hoping there is enough after California to get MY money back and give some to the 2 kids (both over 30 thank goodness - the will said they had to be 29). I have 3 months to locate and list debts on the form for Probate and I think 8 months to get it settled.

It depends. Was the money in his account before he died? SS pays behind, not ahead. It also depends on when his birthday was as that determines when the payment comes in.
Your best bet, no kidding, is too call SSA. They were very helpful and offered condolences every time I spoke with them.
I filed the forms to get the money back in Dec. I need to provide them with my letters as executor and then they should be able to move forward. If you already have those, you can go to your local SSA office so they can make a copy.

I knew they paid behind, just thought if he died during the month they took the money back - double-dipping as it were with first pay a month behind and taking back the last month if death was before the last day of the month (even if you got it on the 3rd. I will check.
I had everything organized before I left and there were so many pieces of paper shoved into the file as I went from bank to bank to bank and realtor and water/electric utility and gas utility, I now have to go through all of it again.

I can only use my example - dad's birthday is early in the month. He got paid early in the month. He died early in the month. BUT, he died after the payment was deposited. I think that's the point they look for. (Payments are made based on dob.)
I called them right after the funeral as I had no idea how this worked. I just didn't want to deal with them trying to get payments back from me later on. They looked at his account and said he got to keep that payment based on date of death vs date of deposit.
I've spoken with three different people and they've all said the same thing.
It's $1000 we can use toward paint and repairs.
